Wearing hijab is not mandatory in Islam: HC

Today (Tuesday) the Karnataka High Court has given its verdict on the Hijab case. The Karnataka High Court has dismissed all the petitions filed on the Hijab case. The Karnataka High Court said that hijab is not an essential part of religion.

A bench of Karnataka High Court Chief Justice Rituraj Awasthi, Justice Krishna S Dixit and Justice JM Kazi was constituted to hear the petition of Muslim girl students of Udupi. These girls had demanded that they be allowed to wear hijab along with school uniform in class as it is part of their religious belief.

Let us tell you that the Karnataka High Court has upheld the hijab ban. The Karnataka High Court has dismissed all petitions by Muslim girl students challenging the permission to wear hijab in colleges and the government order dated February 5. The Karnataka High Court said that no case is made out for invalidating the February 5 government order.

Chief Justice Rituraj Awasthi said that taking a holistic view of the whole matter, we have prepared some questions and have answered accordingly. The first question was whether wearing hijab is a mandatory part of Islam which is protected under Article 25. The second question was whether the school uniform instruction is a violation of rights? The third question was whether the government order of February 5, apart from being incompetent and clearly arbitrary, violates Articles 14 and 15?

Let us know that on January 1, 6 girls from a college in Udupi spoke to the media in a program organized by the Campus Front of India (CFI). It was organized by the college administration against the prohibition of these girls from going to class wearing hijab.

Let us tell you that on February 25, 2022, the hearing was completed in the Karnataka High Court and the High Court had reserved the decision. The Karnataka High Court’s single bench had held the first hearing on 8 February 2022 regarding the Hijab controversy. Then on 9 February 2022, the Single Bench referred the matter to the larger Bench. After this, on February 10, 2022, a 3-judge bench started hearing and until further orders, the religious dress of the students was banned.
